Trademark Act provides legal protection for all registered trademarks. Legal remedy is available in case of infringement by any person or entity. A person is punishable with imprisonment for a term which shall not be less than six months but which may extend to three years and with fine which shall not be less than fifty thousand rupees but which may extend to two Lakh rupees for trademark infringement.
We believe in resolving such disputes amicably and therefore advice the registered owners of trade marks to send Notices to restrict such infringing activities to the alleged infringers.
In case of export goods, there is a remedy to approach the Customs offices with proof of the real Trade mark owner’s registration to restrict the export of such goods. The Government Fees for the said Application is INR 2000/- (Indian Rupees Two Thousand Only).
